Introduction

Please read these Terms of Service (“Terms”) carefully before using the Court One mobile application (“App”) operated by Court One (“we”, “us”, or “our”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are between 13 and 18 years of age, you confirm that you have obtained consent from a parent or legal guardian.

2. Account Registration

To access certain features of the App, you must create an account using a valid email address. You are responsible for:

  • Providing accurate and complete information during registration.
  • Maintaining the confidentiality of your account access.
  • All activities that occur under your account.

You must notify us immediately at [email protected] if you suspect any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the App

3.1 Permitted Use

Court One is a pickleball tournament management application. You may use the App to organise, manage, and participate in pickleball tournaments using the supported formats: Americano, Mixed Americano, Team Americano, King of the Hill, and Club Americano.

3.2 Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorised access to any part of the App or its infrastructure.
  • Upload or transmit any harmful, offensive, or inappropriate content.
  • Reverse engineer, decompile, or disassemble any portion of the App.
  • Use automated tools, bots, or scrapers to access or interact with the App.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the App.

4. Subscriptions and Payments

4.1 Free and Paid Tiers

Court One offers a freemium model with a free tier and paid subscription tiers. Features available under each tier are described within the App and are subject to change.

4.2 Billing

Paid subscriptions are processed through RevenueCat and the applicable app store (Apple App Store or Google Play Store). By subscribing, you agree to the pricing, billing, and refund policies of the applicable platform.

4.3 Cancellation

You may cancel your subscription at any time through your device’s subscription management settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods except where required by applicable law.

4.4 Changes to Pricing

We reserve the right to change subscription pricing at any time. We will provide reasonable notice of any price changes, and your continued use of the paid tier after the effective date constitutes acceptance of the new pricing.

5. Tournament Data and Content

You retain ownership of the tournament data and content you input into the App. By using the App, you grant Court One a non-exclusive, worldwide, royalty-free licence to use, store, and process your content solely for the purpose of operating and improving the App.

You are solely responsible for the accuracy of scores, results, and player information you enter. Court One does not verify tournament data and accepts no liability for disputes arising from inaccurate data entry.

6. Intellectual Property

All intellectual property rights in the App, including but not limited to the Court One name, logo, design, software, and content created by us, are owned by or licensed to Court One. Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use the App in accordance with these Terms.

7. Disclaimers

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COURT ONE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Court One and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another party.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date or providing in-app notice. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

14. Acceptable Use

You may not use Court One for any illegal, harmful, or abusive activity. By way of example, you must not:

  • Engage in any conduct that may harm, disrupt, or degrade the experience of other Court One users or the App itself;
  • Modify, copy, resell, lease, or distribute any part of the App or its content;
  • Circumvent any rate limits, access controls, or safety measures built into the App;
  • Use the App in a way that infringes, misappropriates, or violates the rights of any person or entity, including intellectual property rights and privacy rights;
  • Use the App for any fraudulent, deceptive, or unlawful purpose;
  • Attempt to reverse engineer, decompile, or otherwise discover the source code or underlying components of the App; or
  • Use any automated means — including bots, scripts, or scrapers — to access, collect, or interact with any part of the App.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Court One regarding your use of the App and supersede all prior agreements and understandings.
